Terms of Service
What you are buying, what we promise, and what we cannot promise. Written to be read — if anything here is unclear, ask us before you pay.
In effect from 19 August 2026. Markham Visa & Document Services, 3601 Highway 7 East, Suite 1005, Markham, ON L3R 0M3. Questions about anything on this page: info@markhamvisa.ca or (647) 696-0986.
1.Who we are, and what these terms cover
These terms form the agreement between you and Markham Visa & Document Services (“we”, “us”), a private company operating from 3601 Highway 7 East, Suite 1005, Markham, ON. They apply when you buy any service from us, in the office or through this website.
You accept them when you place an order. If you do not accept them, do not place an order.
We are not a government body. We are not affiliated with, endorsed by, or acting for any government, embassy, consulate, high commission, or official visa application centre. We do not decide any application. We are not a licensed provider of Canadian regulated advice, and we do not give it — see clause 3.
2.Best-efforts service — no guaranteed outcome, no guaranteed date
Everything we do is on a best-efforts basis. You are paying us for our work in preparing, checking, and submitting your application, and for our handling of your documents. You are not paying for a result.
Outcome. Whether a visa, apostille, authentication, or any other document is granted, refused, delayed, or cancelled is decided solely by the issuing authority. That decision is entirely outside our control. A refusal is not a failure of our service and does not entitle you to a refund. Anyone who promises you an approval is not telling you the truth.
Timing. Any date we give you — on a quote, in an email, in your order tracking, or in conversation — is an estimate based on processing times we are currently observing. It is not a guarantee and not a contractual deadline. Processing times change without notice, authorities close for holidays and other reasons, and applications are sometimes selected for additional checks. We will tell you promptly if we learn your estimate has moved.
Because of this, you should never book non-refundable travel, or commit to any deadline that matters to you, on the strength of an estimate from us. We are not responsible for losses arising if you do — see clause 9.
3.What we do not do
- We do not give advice on Canadian status, admissibility, refugee matters, sponsorship, or any other regulated matter. That work is restricted by law to licensed professionals. If your question falls into that territory we will say so and refer you to a licensed RCIC or a lawyer.
- We do not attend interviews for you, and we cannot influence an officer’s decision.
- We do not represent you before any authority except to the extent of lodging and collecting the application we prepared.
- We do not accept work that would require us to submit information we believe to be false or misleading. We will withdraw from a file rather than do so, and clause 6 applies.
4.Your responsibilities
Our work depends on what you give us. You are responsible for:
- Accuracy. Every detail you provide must be true, complete, and match your passport and supporting documents exactly. You are responsible for the content of your application even where we prepared it for you.
- Promptness. Providing documents, signatures, payments, and answers without delay. Any estimate we give assumes you do. Time you take is added to your date.
- Checking before submission. Where we send you a prepared application, form, or summary to review, you must check it and tell us about any error before we submit. Once you approve it, you accept it as correct.
- Eligibility. Holding a valid passport with enough remaining validity and blank pages, and meeting the entry requirements of your destination.
- Your own travel decisions. Including when to book flights and accommodation.
If you do not respond to us for 90 days, we may close your file. Fees for work already done are not refundable, and we will return any physical documents we hold to the address we have for you.
5.Prices, fees and payment
The price shown to you before payment is the price you pay. We do not add charges afterwards. Our prices take one of two shapes, and the quote tells you which:
- An all-inclusive fee — a single amount covering our work and any consular cost, absorbed by us and not itemized.
- An itemized quote — our service fee shown separately from the government fee, which is passed through at cost. We never mark up a government fee.
Government and third-party fees are set by others and can change without notice. If a fee changes after you order but before we submit, we will tell you and you may either pay the difference or cancel under clause 6.
We accept Interac e-Transfer and credit card. Card payments are processed by Stripe; we never see or store your full card number. Card statements show “MARKHAM VISA & DOC SVCS”.
6.Cancellation and refunds
Once we have started work on your file, our fees are not refundable. This is because our fee pays for our time and attention, which is spent whether or not the authority says yes.
Work has started at the earliest of the moment when we:
- begin preparing, checking, or reviewing your application, including by automated preparation;
- contact an authority, consulate, or application centre about your file;
- submit your application; or
- pay a government or third-party fee on your behalf.
Before work has started, tell us and we will refund what you paid, less any cost we have already incurred on your behalf and any payment-processing fee we cannot recover. Ask as soon as you can — on most orders we begin quickly.
Government fees are never refundable by us once paid to the authority, whatever the outcome. If you want a government fee back, that is a matter between you and that authority.
If we decide not to proceed with your file for a reason that is not your fault, we will refund the fees for work we have not done.
7.Your documents
Where we handle physical originals, we log them in and out and keep a record of custody. We treat them as carefully as we can, but we are not an insurer.
- Once documents leave us for an authority or a courier, they are in that party’s hands. We are not responsible for loss, damage, or delay caused by an authority, a courier, or the postal system.
- If you choose to have documents sent to you directly from a government office, they do not pass back through us and we cannot check them before they reach you. You accept that when you choose it.
- Some documents are affixed, stamped, or altered by the issuing authority as part of the process. That is normal and is not damage.
- We cannot replace a government-issued document. Where a document is replaceable, our responsibility is limited under clause 9.
8.Automated preparation
We use automated tools, including artificial intelligence, to help prepare and check applications. Those tools never submit anything and never make a decision about your file. A person reviews every application before it is submitted, and that person is responsible for it. Our Privacy Policy explains what is processed and by whom.
9.Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Ontario or Canadian law — including your rights under the Consumer Protection Act, 2002, which you keep in full regardless of what this page says.
Subject to that:
- Our total liability to you for any order is limited to the service fees you paid us for that order.
- We are not liable for indirect or consequential losses. That includes lost, cancelled, or rebooked travel; missed events, deadlines, work, or study; accommodation costs; and lost profit or opportunity — whether or not you told us the trip mattered.
- We are not liable for a refusal, a delay, a change of rules, or any other act of an authority.
- We are not liable for anything caused by information you gave us that was inaccurate or incomplete, or given to us late.
10.Privacy
We handle personal information under Canadian privacy law. Our Privacy Policy forms part of these terms and explains what we collect, where it is stored, who we share it with, and how to reach us about it.
11.Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it, and the date it took effect is shown at the top of this page. Material changes will not be applied to an order already under way.
12.Governing law
These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Disputes go to the courts of Ontario. If any part of these terms is unenforceable, the rest continues to apply.
